The recent California Court of Appeal decision in Cochran v. Schwan’s Home Service, Inc. set new precedent requiring employers who allow their employees to use cell phones for business purposes to reimburse those employees a “reasonable percentage” of their cell phone bills, regardless of whether the cell phone plan includes limited or unlimited minutes. Employers may consider re-evaluating their Bring Your Own Device policies and need to be aware of pitfalls associated with allowing employees to use their personal devices for business purposes, which may impact the drafting of social media and confidentiality policies.
